I changed my opinions about the costume, it looks great and I'm glad that the other photos were really just the stunt costume.
Anyways it's still not great as the original costume though but hey, this has potential. >:D

Now this is a picture of Andrew Garfield without the mask, looks like the reboot will really be dark.

Yes, it is now confirmed that this is just a stunt costume but they are still not sure if he's really wearing those shoes on the movie but it's probably for the stuntman to do the stunts.

I'll miss Toby McGuire...
I believe I remember hearing that McGuire, along with the director, left the films before they decided to reboot; back when they were planning for a Spiderman 4.
Well, damnit. This movie does not deserve to be seen without Toby to me.

Any reason why?
I'd assume the director wanted to be known for something other than Spider-Man and that McGuire felt he needed to escape the role while he could. I'm sure, as an actor, that he'd like to work on other projects besides Spider-Man.
