It does! I'd even go as far as to call it a rip-off!
These are basically the same characters, stances and even some movesets.

That sure as hell didn't stop Super Meat Boy.

Maybe if they worked with different aesthetics to make the game look less bland and forgettable.

Making in 2D is way easier.
This game here is made by the guys who did Mortal Kombat Armageddon, so it might be really fun.

I still personally think it would work to their advantage if they changed the aesthetics and the title.
Cause right now, all I see is tastless DoA rip-off.
